Director-General completes Bill of Rights analysis on fluoridation

The Director-General of Health has written to Waitaki District Council announcing the completion of the required New Zealand Bill of Rights Act (NZBORA) analysis for the direction to fluoridate made in 2022.

The assessment finds that in terms of Section 5 of the NZBORA, community water fluoridation in the Oamaru water supply is a justified limit on the right to refuse medical treatment that is provided for in Section 11 of the NZBORA.

The Director-General of Health has therefore reconfirmed the direction to fluoridate the Ōamaru water supply.

Waitaki District Council is not currently fluoridating the Ōamaru water supply as we await parts and contractor availability. It is likely to recommence in January 2025, and Council will update the community about this when we have more detailed information.
